ШЛЯХИ ПОДОЛАННЯ ПРОБЛЕМИ НЕЗАКОННОГО, НЕПІДЗВІТНОГО І НЕРЕГУЛЬОВАНОГО РИБАЛЬСТВА В ЄВРОПЕЙСЬКОМУ СОЮЗІ: ЯК ПРИКЛАД ДЛЯ УКРАЇНИ
Анотація
Україна – країна з великим потенціалом, яка знаходиться в стадії реформування багатьох галузей. Ці реформи тісно пов’язані з курсом на вступ України до Європейського Союзу. Однак, рибогосподарська галузь потребує реформ. Зовнішньополітичний стратегічний курс України на набуття членства в ЄC - це не просто слова, а реальність. Нашу увагу привертають проблеми у сфері риболовства. Однією з яких є: недосконале управління щодо незаконного, непідзвітного і нерегульованого рибальства.
У статті розглядаються такі поняття як незаконний, непідзвітний, нерегульований промисел (ННН-промисел). ННН-промисел – це серйозна загроза ефективному збереженню багатьох рибних запасів та управління ними, що викликає численні несприятливі наслідки для рибальства і людей, які залежать від нього в прагненні забезпечити собі законні засоби для існування.
Встановлено, що в Європейському Союзі, який є орієнтиром для нашої держави, приділяється значна увага проблемі незаконного, непідзвітний та нерегульованого рибальства. В Україні реагування на ННН-промисел досі не є адекватним. Мізерні штрафні санкції не покриють тієї шкоди, що завдають галузі суб’єкти які порушують закон.
Україна є членом ФАО (Продовольча та сільськогосподарська організація Об'єднаних Націй), що опікується проблематикою ННН-промислу. Але, на жаль, на практиці в нашій державі ми спостерігаємо не достатній законодавчий вплив відповідальних інститутів на запобігання ННН-промислу.
Доведено, що інноваційна політика боротьби Європейського Союзу з незаконним, непідзвітним, нерегульованим рибальством не дозволяє рибним продуктам отримати доступ до Європейського Союзу, якщо вони не сертифіковані та покладає на держави прапору, прибережні, портові та ринкові держави відповідальність за свої міжнародні зобов’язання в боротьбі з незаконним рибним промислом (схема сертифікації вилову та діалоги та співробітництво.
Досліджено, що за статистичними даними загальний обсяг виробництва рибної продукції в Україні у 2020 році менша показника 2019 року.
Проаналізовано, що в Україні поняття «незаконне рибальство», «непідзвітне рибальство», «нерегульоване рибальство» регулюється законом України «Про рибне господарство, промислове рибальство та охорону водних біоресурсів», а відповідальність за порушення правил рибальства в українському законодавстві передбачена Кримінальним кодексом України та Кодексом України про адміністративні правопорушення. Однак розміри санкцій дуже малі.
Крім згубних економічних, соціальних, екологічних наслідків і наслідків для безпеки, несправедливість ННН-промислу викликає серйозні побоювання. За визначенням, ННН промисел є або явно незаконним видом діяльності, або, як мінімум, діяльністю, що здійснюється без дотримання застосовних стандартів.
Реалізовуючи свій євроінтеграційний курс, Україна має впроваджувати управлінські практики які діють в ЄС в сфері рибальства та аквакультури задля збереження промислового потенціалу та розвитку цієї галузі.

WAYS TO OVERCOME THE PROBLEM OF ILLEGAL, UNRECAUTABLE AND UNREGULATED FISHERIES IN THE EUROPEAN UNION: AS AN EXAMPLE FOR UKRAINE
Summary
Ukraine is a country with great potential, which is in the process of reforming many industries. These reforms are closely linked to Ukraine's accession to the European Union. However, the fisheries sector needs to be reformed. Ukraine's foreign policy strategic course towards EU membership is not just a word, but a reality. Our attention is drawn to the problems in the field of fisheries. One of them is: imperfect management of illegal, unaccountable and unregulated fishing.
The article considers such concepts as illegal, unaccountable, unregulated fishing (IUU fishing). IUU fishing poses a serious threat to the effective conservation and management of many fish stocks, with many adverse consequences for fisheries and the people who depend on them in their quest to secure legal livelihoods.
It is established that in the European Union, which is a reference point for our country, much attention is paid to the problem of illegal, unaccountable and unregulated fishing. In Ukraine, the response to IUU fishing is still inadequate. The meager penalties will not cover the damage done to the industry by offenders.
Ukraine is a member of the FAO (Food and Agriculture Organization of the United Nations), which takes care of IUU fishing. But, unfortunately, in practice in our country we see insufficient legislative influence of responsible institutions on the prevention of IUU fishing.
It has been proven that the European Union's innovative policy to combat illegal, unreliable, unregulated fisheries prevents fishery products from gaining access to the European Union if they are not certified and makes flag, coastal, port and market states accountable for their international obligations to combat with the illegal fishing industry (catch certification scheme and dialogues and cooperation.
It is investigated that according to statistical data, the total volume of fish production in Ukraine in 2020 is less than in 2019.
It is analyzed that in Ukraine the concepts of "illegal fishing", "unaccountable fishing", "unregulated fishing" are regulated by the Law of Ukraine "On Fisheries, Industrial Fisheries and Protection of Aquatic Bioresources", and the responsibility for violating fishing rules in Ukrainian law Code of Ukraine on Administrative Offenses. However, the size of the sanctions is very small.
In addition to the detrimental economic, social, environmental and security consequences, the injustice of IUU fishing raises serious concerns. By definition, IUU fishing is either a clearly illegal activity or, at the very least, an activity carried out without compliance with applicable standards.
Implementing its European integration course, Ukraine must implement management practices in the EU in the field of fisheries and aquaculture in order to preserve the industrial potential and development of this industry.
