СУБ’ЄКТИ І ОБ’ЄКТИ У СФЕРІ НЕЛЕГАЛЬНОЇ МІГРАЦІЇ

Анотація

У статті визначено суб’єкти і об’єкти у сфері нелегальної міграції в Україні. Автором обґрунтовано організаційно-функціональну систему, яка виступає ядром забезпечення реалізації національних інтересів у сфері міграційної політики України. Доведено, що Україна не має чіткої концепції організаційного та структурного забезпечення реалізації міграційної політики, проведення цієї роботи потребує особливої уваги. Визначено, що для регулювання міграційних потоків та подолання негативних наслідків міграції формується міграційний режим. Формування і підтримка цього режиму забезпечується за допомогою різних механізмів, серед яких ми виділено механізм протидії нелегальній міграції. Цей механізм складається з трьох компонентів, одним з компонентів якого є організаційно-структурні формування протидії нелегальній міграції (об’єкти та суб’єкти, які здійснюють протидію нелегальній міграції).

SUBJECTS AND OBJECTS IN THE FIELD OF ILLEGAL MIGRATION

Summary

The article defines the subjects and objects in the field of illegal migration in Ukraine. The author substantiates the organizational and functional system, which is the core of ensuring the implementation of national interests in the field of migration policy of Ukraine. It has been proved that Ukraine does not have a clear concept of organizational and structural support for the implementation of migration policy; this work requires special attention. It has been determined that a migration regime is formed to regulate migration flows and overcome the negative consequences of migration. The formation and maintenance of this regime is provided with the help of various mechanisms, among which we have highlighted the mechanism of counteracting illegal migration. This mechanism consists of three components, one of which is the organizational and structural formations of countering illegal migration (objects and subjects that counter illegal migration). Among the objects of public administration in the field of counteracting illegal migration, the author highlights: national values, interests and goals - the basis for promoting the state by the chosen European course; public order and the fight against crime related to illegal migration; public relations in the field of combating illegal migration; system of counteracting illegal migration in Ukraine. The main subjects of public administration in the field of combating illegal migration are state bodies; local government bodies; public organizations; international representations. It was determined that as a result of such interaction, these subjects complement each other, as a result of which they form an organizational and functional system, which acts as the core of ensuring the implementation of national interests in the field of migration policy of Ukraine. The primary goal of the State Migration Service is to regulate migration flows, overcome the negative consequences of migration processes developing spontaneously, create conditions for the unhindered realization of the rights of migrants, as well as ensure a humane attitude towards persons seeking protection on the territory of Ukraine.
