ТЕОРЕТИЧНІ ЗАСАДИ ФОРМУВАННЯ СПРОМОЖНОСТІ ТЕРИТОРІАЛЬНИХ ГРОМАД В УКРАЇНІ
Анотація
У статті розглянуто поняття “територіальна громада”, “спроможна територіальна громада”, “формування спроможної територіальної громади”.
Акцентовано увагу на тому, що існує різноманітність підходів до трактування поняття “територіальна громада”. Наприклад, територіальна громада – це жителі одного чи декількох населених пунктів, які добровільно об’єднуються в одну територіальну громаду для вирішення питань місцевого значення.
Визначено функції, якими наділена територіальна громада, зокрема: нормотворча; бюджетно-фінансова; інвестиційна; інформаційна; планування, програмування розвитку адміністративно-територіальної одиниці базового рівня; управління ресурсним потенціалом; розвиток місцевої інфраструктури; управління комунальним майном, що належить територіальні громаді; управління мережею закладів соціальної сфери.
Розглянуто власні та делеговані повноваження об’єднаних територіальних громад. Встановлено, що розподіл повноважень – це один із головних принципів децентралізації, відповідно до якого найбільше повноважень мають мати ті органи влади, які є найближчими до людей і на рівні яких вирішення завдань та надання послуг є найбільш ефективним та найменш ресурсовитратним.
Встановлено зміст поняття “спроможна територіальна громада”. Це територіальні громади сіл (селищ, міст), які в результаті добровільного об’єднання здатні самостійно або через відповідні органи місцевого самоврядування забезпечити належний рівень надання послуг, зокрема у сфері освіти, культури, охорони здоров’я, соціального захисту, житлово-комунального господарства, з урахуванням кадрових ресурсів, фінансового забезпечення та розвитку інфраструктури відповідної адміністративно-територіальної одиниці.
Тобто спроможною територіальною громадою є така громада, у якій місцеві джерела наповнення бюджету, інфраструктурні та кадрові ресурси є достатніми для вирішення її органами місцевого самоврядування питань місцевого значення, передбачених законодавством, в інтересах жителів громади.
На основі аналізу літературних джерел встановлено, що науковці розглядають спроможність територіальної громади як внутрішню та зовнішню; потенціальну (розрахункову), реальну та юридичну; бюджетну, інфраструктурну та кадрову.
Розглянуто принципи формування спроможності територіальних громад.

THEORETICAL PRINCIPLES OF CAPACITY BUILDING OF TERRITORIAL COMMUNITIES IN UKRAINE
Summary
The article considers the concepts of “territorial community”, “capable territorial community” and “formation of a capable territorial community”.
Emphasis is placed on the fact that there is a variety of approaches to the interpretation of the category “territorial community”. For example, a local community is a resident of one or more localities who voluntarily form a local community to address local issues.
The functions of the territorial community are determined, in particular: normative; budget and financial function; planning, programming of development of the administrative-territorial unit of the basic level; resource potential management; local infrastructure development; management of communal property belonging to territorial communities; management of the network of social institutions; investment; informational.
The own and delegated powers of the united territorial communities are considered. It has been established that the division of powers is one of the main principles of decentralization, according to which the authorities that are closest to the people and at the level of which the solution of tasks and provision of services is the most efficient and least resource-intensive should have the most powers.
The meaning of the concept of “capable territorial community” is established. These are territorial communities of villages (settlements, cities), which as a result of voluntary association are able to independently or through relevant local governments to ensure the appropriate level of service provision, in particular in the field of education, culture, health, social protection, housing and communal services. , taking into account human resources, financial support and infrastructure development of the relevant administrative-territorial unit.
That is, a viable territorial community is a community in which local sources of budget, infrastructure and human resources are sufficient for its local governments to address issues of local importance provided by law, in the interests of community residents.
Based on the analysis of literature sources, it is established that scholars consider the capacity of the territorial community as internal and external; potential (estimated), real and legal; budget, infrastructure and personnel.
The principles of capacity building of territorial communities are considered.
