CУБ’ЄКТИ ДЕРЖАВНОЇ ПОЛІТИКИ У СФЕРІ ЗАХИСТУ ПРАВ ДІТЕЙ

Анотація

У статті розглянуто основні суб’єкти державної політики у сфері захисту прав дітей в Україні, зокрема Уповноважений Президента України з прав дитини, Кабінет Міністрів України, суди, органи місцевого самоврядування, органи і служби у справах дітей та спеціальні установи для дітей, Національна поліція та її спеціальні установи (приймальники-розподільники для дітей), загальноосвітні школи та професійні училища соціальної реабілітації, Центри медико-соціальної реабілітації дітей, Центри соціально-психологічної реабілітації дітей, спеціальні виховні установи Державної кримінально-виконавчої служби, притулки для дітей, соціально-реабілітаційні центри (дитячі містечка), громадськість.
Встановлено, що створення інституції Уповноваженого Президента України з прав дитини відповідає Конвенції ООН про права дитини та рекомендаціям Комітету ООН про права дитини.
Проаналізовано правову основу діяльності Уповноваженого Президента України з прав дитини та встановлено, що зазначена інституція не є абсолютно самостійною у своїй діяльності. Її функціонування відбувається шляхом безперервної взаємодії із Президентом України, який є гарантом додержання прав і свобод людини, а Уповноважений Президента України з прав дитини, у свою чергу, забезпечує здійснення Президентом України повноважень щодо забезпечення конституційних прав дітей.
Акцентовано увагу на тому, що в Україні система органів і служб у справах дітей та спеціальних установ для дітей має достатньо розгалужену структуру, кожен ланцюг якої здійснює конкретну компетенцію для забезпечення прав дитини.
Розглянуто основні функції та повноваження суб’єктів державної політики у сфері захисту прав дітей в Україні, на основі чого встановлено, що органами місцевого самоврядування максимально наближені до проблем дитинства та володіють цією інформацією більше, ніж інші органи влади.
Запропоновано посилити вплив громадськості на реалізацію державної політики щодо захисту прав дітей. Це сприятиме створенню системи громадянської освіти (зокрема, запровадження у навчальних закладах спеціалізованих дисциплін, спрямованих на формування громадянськості; проведення для учнів середніх шкіл позакласних заходів із громадянської освіти; періодичне опублікування у засобах масової інформації матеріалів, спрямованих на підвищення загальної поінформованості про демократичне громадянство, а також про права дітей, контроль за їх дотриманням).

SUBJECTS OF STATE POLICY IN THE FIELD OF PROTECTION OF THE RIGHTS OF THE CHILD

Summary

The article deals with the main subjects of the state policy in the sphere of protection of the rights of children in Ukraine, including the Commissioner of the President of Ukraine for the Rights of the Child, the Cabinet of Ministers of Ukraine, courts, local authorities, bodies and services for children and special institutions for children, the National Police and its special institutions (distribution centers for children), general education schools and vocational schools for social rehabilitation, Centers for medical and social rehabilitation of children, Centers for social and psychological rehabilitation of children, special lni educational institutions of the State Penal Service, shelters for children, social rehabilitation centers (children's camp), public.
It is established that the establishment of the Office of the Presidential Ombudsman of Ukraine is in accordance with the UN Convention on the Rights of the Child and the recommendations of the UN Committee on the Rights of the Child.
The legal basis of the activity of the Ombudsman of Ukraine is analyzed and it is established that the said institution is not completely independent in its activity. Its functioning is carried out through continuous interaction with the President of Ukraine, which is a guarantor of respect for human rights and freedoms, and the Presidential Commissioner for the Rights of the Child, in turn, ensures the President's exercise of powers to ensure the constitutional rights of children.
Attention is drawn to the fact that in Ukraine the system of bodies and services for children and special institutions for children has a sufficiently branched structure, each chain of which has specific competence to ensure the rights of the child.
The basic functions and powers of the state policy makers in the field of protection of children's rights in Ukraine are examined, on the basis of which it is established that local self-government bodies are as close as possible to the problems of childhood and possess this information more than other authorities.
It is proposed to increase the influence of the public on the implementation of the state policy on protection of children's rights. This will facilitate the creation of a civic education system (in particular, the introduction of specialized subjects aimed at forming citizenship in educational establishments; conducting extracurricular activities in civic education for secondary school students; periodical publication of media aimed at raising awareness and promoting awareness also about children's rights, control over their observance).
