ЗАХИСТ ПРАВ ЮРИДИЧНИХ ОСІБ В КОНТЕКСТІ КОНВЕНЦІЇ ПРО ЗАХИСТ ПРАВ ЛЮДИНИ І ОСНОВОПОЛОЖНИХ СВОБОД
Анотація
Стаття присвячена можливостям захисту прав юридичних осіб в Європейському Суді в прав людини. На основі українського законодавства, Конвенції про захист прав людини та практики Європейського Суду з прав людини автор розкриває значення понять «юридична особа» та «неурядова організація», визначає коло юридичних осіб, які можуть бути суб’єктами звернення до ЄСПЛ. У статті з’ясовується, які з прав, передбачених Конвенцією про захист прав людини і основоположних свобод, визнаються за юридичними особами і можуть бути предметом захисту в Європейському Суді в прав людини. Стаття містить аналіз практики Європейського Суду з прав людини щодо найбільш розповсюджених позовів юридичних осіб. Вказується на переваги і недоліки розгляду справ Європейським Судом з прав людини.

LEGAL ENTITIES’ RIGHTS PROTECTION IN CONTEXT OF CONVENTION FOR THE PROTECTION OF HUMAN RIGHTS AND FUNDAMENTAL FREEDOMS
Summary
The article is devoted to possibilities of legal persons before the European Court of Human Rights. On the basis of Ukrainian legislation, the Convention of Human Rights and the case-law of the European Court of Human Rights the author reveals the meaning of the concepts «legal person» and «non-governmental organization» and indicates a circle of legal persons eligible to complain to the European Court of Human Rights. The article determines the list of rights under the Convention for the Protection of Human Rights and Fundamental Freedoms which may belong to legal entities and be a subject to protect by the European Court of Human Rights. This article contains an analysis of the case-law of the European Court of Human Rights concerning the most common kinds of applications of legal persons. The author mentions advantages and disadvantages of legal persons’ reference to the European Court of Human Rights.
